1) The Base Map has been provided to the user by the City solely for the purposes of the {study description} and shall not be used for any other purpose or purposes whatsoever without the express prior written consent of the City.
2) The Base Map and its derivatives is and shall remain the sole property of the City and shall not be shared with any other party, whether or not for profit, without the express prior written consent of the City.
3) Upon completion of the {type of study} ,the user shall return all discs containing any portion of the Base Map to the City and, if directed by the City, shall delete the Base Map from the hard drive of any and all computer or computers on to which it may have been copied.
4) In the event of any improper use of the Base Map, in contravention of the provisions of this Agreement, the City shall be entitled to immediately recover from the user liquidated damages, the amount of which liquidated damages shall be equal to the entire cost to the City (including all professional fees) previously incurred in assembling the Base Map.
5) The user hereby agrees to indemnify and hold harmless the City against and from all costs and expenses incurred by the City arising out of any breach of this Agreement by the user which shall include (without limitation) all legal costs and expenses incurred by the City in enforcing the obligations of the user hereunder.
6) The Base Map is provide "as is" without warranty or any representation of accuracy, timeliness or completeness. The burden for determining accuracy, completeness, timeliness, merchantability and fitness for or the appropriateness for use rests solely on the requester. The City of New Haven makes no warranties, express or implied, as to the use of the Base Map. There are no implied warranties of merchantability or fitness for a particular purpose. The requester acknowledges and accepts the limitations of the Base Map, including the fact that the Base Map is dynamic and is in a constant state of maintenance, correction and update.
7) This Agreement shall be binding upon the successors and assigns of the user and shall inure to the benefit of the City and the City's successors and assigns.
8) This Agreement is made under, and shall be construed in accordance with, the laws of the State of Connecticut.ShapefileThe geocoding attributes have gone through a very rigerous improvement project.
Refer to the 2002 New Haven Street Centerline Improvement Project printed report for more details.The centerline shapefile has been through a through QA/QC process to assure that all streets intersect and there are no duplicate arcs. The centerline alignment has been viewed against the New Haven B&W aerial photos with a very high level of agreement. The geocoding tests for intersections revealed very few noiontersecting streets which were corrected.This centerline file is believed to represent all of the actual streets in the City of New Haven plus paper streets as noted by the City Assessor.
